Himachal Pradesh High Court’s Decision on River Rafting Safety

Himachal Pradesh High Court has ordered the Deputy Commissioner of Kullu district to establish an upper age limit for risky activities like river rafting and kayaking. The court emphasized the importance of older adults providing a fitness certificate. The court’s order builds on previous decisions and aims to strengthen safety precautions in river sports.

According to a recent update, the Deputy Commissioner of the Kullu district has received an order from the Himachal Pradesh High Court requesting the establishment of an upper-age restriction for those who engage in risky activities like river rafting and kayaking in the area.

In addition, the bench, which consists of Justice MS Ramachandra Rao and Jyotsna Rewal Dua, discussed the significance of mandating that older adults who participate in these kinds of activities provide a “fitness certificate,” according to Live Law.

According to the court, “It is desirable to establish an upper age limit for individuals intending to participate in kayaking or related river sports, and also to mandate senior citizens participating in such activities to provide a Fitness Certificate.”

The High Court examined the application of safety rules for river rafting and other extreme sports in November 2023. In the course of this review, the court pointed out safety procedure flaws and occasions where Rule 11(b) of the Himachal Pradesh River Rafting Rules, 2005 was broken. According to this regulation, those who run river rafts have to have either two rescue rafts or a raft plus a kayak.

The court’s latest order, which builds on earlier decisions, intends to strengthen safety precautions in river sports, especially in light of the terrible loss of a 65-year-old visitor.

The court has set July 18 for more discussion of the case.
